GLADSTONE, Mich. (WZMQ) – The City of Gladstone has received an order from the Delta County Circuit Court dismissing five cases filed by Michael O’Connor against the City.
According to a press release from the City, the cases generally alleged violations of the Gladstone Charter. The City filed a motion for summary disposition arguing that O’Connor lacked legal standing to bring the claims.
Following a review of the parties’ briefs and exhibits and oral argument, the Court granted the City’s motion, dismissing all five cases. In its decision, the Court explained that standing requires a litigant to have a special injury, right, or substantial interest that is affected differently from the public at large, unless standing is otherwise provided by statute.
“Generally, Plaintiff brought these suits alleging violations of the city charter,” the Court wrote. “Plaintiff has not alleged any unique or special injury that is different from any other citizen of the City. Therefore, the Court must dismiss all cases.”
The Memorandum of Decision and Order was signed September 9, 2026, by the Hon. Brian D. Rahilly of the Delta County Circuit Court.
