Former Special Counsel Jack Smith Testifies in Fiery Senate Committee, Stands by his Decisions to Charge Trump

WASHINGTON, D.C. – Jack Smith, the former Special Counsel who investigated and prosecuted the President with serious crimes after he left office, is sticking by his work. Smith testified in a fiery Senate Judiciary Committee where Republicans accused him of abusing his authority and targeted Republicans. 

Smith testified that he stands by his work, “including my decision to bring charges against President Trump,” said Smith. “I made those decisions without regard to President Trump’s political association, activities, beliefs, or candidacy in the 2024 presidential election. Our investigation developed proof beyond a reasonable doubt that President Trump engaged in serious crimes against our nation. If asked whether to prosecute a former president today, based on the same facts, I would do so regardless of whether that president was a Republican or a Democrat.” 

Smith brought two indictments against the President; One as mishandling classified documents at Donald Trump’s Florida home and the other charge was the criminal case accusing the President of trying to overturn the 2020 presidential elections, in which Trump lost.  

Republicans pressed Smith about his team’s access to phone records of republican lawmakers when prosecutors investigated Trump’s efforts to reverse the 2020 election loss. The data, known as toll records, do not reveal the content of communications, just the date, time and length of phone calls between two parties.  

“Mr. Smith’s operation was a partisan weapon that broke the rules, lied to the court, and engaged in bad faith throughout,” said Sen. Chuck Grassley (R- IA), Senate Judiciary Chairman. “His operation has no credibility, only to the partisan media and Democrats who cheered him on, as they will do today.” 

The hearing comes after a July House Judiciary Committee where the Chairman referred Smith to the Justice Department for potential prosecutions on allegations he lied at a previous hearing about his collection of the records, but Smith said he stands by his work.  

“As with my appearance before the US House of Representatives Committee on the Judiciary, I am prepared to answer your questions truthfully,” said Smith. “I stand by my testimony before the House of Representatives, and I will not be silenced by continued threats of prosecution from the president or others.” 

When President Trump won the 2024 election, Smith dropped the charges against the President, citing the DOJ’s opinion that sitting Presidents cannot be federally indicted.
